Legal
These terms apply whenever you sell a device to Buyback Point, online or at the counter. We've written them in plain language on purpose.
Buyback Point is a secondhand electronics dealer with a walk-in store at 1879 W Flagler St, Miami, FL 33135. You can reach us at 305-925-0840 or sell@buybackpoint.com during opening hours: Monday to Friday 9am to 7pm, Saturday 10am to 2pm, closed Sunday. In these terms, "we" and "us" mean Buyback Point. "You" means the person selling us a device.
The price we show you online is a conditional offer to buy, based entirely on the description you give us. It is not a valuation and not a guarantee of final payment. It becomes binding on us when the device reaches us and matches that description.
A quote is valid for 14 calendar days from the date you accept it. If the device reaches us after that window, we will re-price it at the current market rate and tell you the new figure before doing anything further. Prices for used electronics change constantly, which is why the window exists.
If a quote is displayed with an obvious error — a pricing fault, a data error, a figure far outside the market for that model — we may correct it and tell you. We will never substitute a lower number without saying so.
Every device we receive is erased, then tested: power, display, battery, cameras, ports, buttons, audio, connectivity, lock status, and an IMEI or serial check against the national blacklist where applicable. Inspection normally takes one to two business days from the day your package arrives. In store, inspection happens at the counter while you wait.
We record what we find, including photographs where relevant, and keep that record with the transaction.
If the device does not match the description — a different storage size, a fault you did not mention, a lower grade, a battery below threshold, an account still signed in — we will email you a revised offer that states exactly what we found and what changed.
You then have 10 calendar days to do one of three things:
If we do not hear from you within those 10 days, we return the device to you for a $10 shipping fee. We never treat silence as acceptance of a revised offer.
If the device turns out to be worth more than quoted, we increase the offer without being asked.
A revised offer only happens when the device does not match what you told us when you got your quote — for example you said it was in good condition and it arrived cracked, or you said the controller was included and it was not. In that case the return is not our cost: if you decline a revised offer, you pay the return shipping, a flat $10. If we made the mistake — we damaged the device, or it matched your description and we cannot honor our quote — we return it at our expense. There is no inspection fee, handling fee or restocking fee at any point. A returned device comes back in the condition it arrived in, except that it has been erased, because we erase every device on arrival. Back up your data before you send anything.
If a device has no resale value at all, you may ask us to recycle it free instead of returning it. That is your choice, not ours.
By selling a device to us you confirm, for each item, that:
We may still choose to buy a financed, carrier-locked or account-locked device, but only on a manually confirmed basis and at a reduced price, and only once you have disclosed the issue. We record the serial number or IMEI of every item we buy, retain those records, and cooperate fully with law enforcement. If a device we bought is later identified as stolen, you agree to refund what we paid and to reimburse any reasonable costs we incur.
You are responsible for removing SIM cards, memory cards and personal accessories before sending or handing over a device. We cannot return items we did not record as received.
Florida law requires secondhand dealers to verify and record the identity of anyone selling to them, together with a description of each item purchased, and to make those records available to law enforcement. For that reason we require a valid government-issued photo ID for every in-store purchase, and we may decline a transaction if you cannot provide one. We must be dealing with the seller directly; we cannot buy from someone acting on behalf of an absent seller without written authorization.
We only buy from sellers aged 18 or over.
Devices we buy are held, unaltered and available for inspection, for the period Florida law requires of secondhand dealers before they may be resold, dismantled or altered. Nothing is parted out, repaired or listed for sale before that period ends and before payment to you has cleared.
We pay by cash in store, Zelle, PayPal, mailed check, or store credit at 10 percent above the cash offer. In store, payment is immediate on acceptance. For mail-in orders, payment is issued within one business day of the offer being confirmed; a mailed check typically takes a further three to seven days to arrive.
We pay only the person named on the order, and for in-store sales only the person whose identification we recorded. We cannot redirect payment to a third party. We will never ask you for a bank account number, routing number, card number or password. Any message claiming otherwise is not from us.
Payment is in US dollars. Store credit has no cash value, does not expire, and is not transferable.
Devices shipped to us on our prepaid label are covered up to $100 while in transit. Above that amount, coverage is only available if arranged with us in writing before shipping. We are not responsible for loss or damage caused by inadequate packaging, by shipping a prohibited item such as a swollen or damaged lithium battery, or by using a label or address other than the one we provided. Risk passes to us when the package is recorded as received at our address.
If you decline an offer and we cannot complete a return because the address you gave is wrong or undeliverable, we will contact you at the details on your order. If we have had no response 90 days after the return was first attempted, the device is treated as abandoned and we may recycle or dispose of it. We will have made at least two documented attempts to reach you first.
We decline items that are reported lost or stolen, items we have reason to believe are not yours to sell, items with safety hazards we cannot handle safely, and items prohibited from sale by law. We may decline any transaction at our discretion, and we do not have to explain a decline beyond telling you that we are not proceeding.
We are responsible for handling your device with reasonable care while it is with us. Our total liability in connection with any transaction is limited to the greater of the amount we quoted for that device or $100, except where Florida law does not allow that limit. We are not liable for indirect or consequential losses, including lost data, lost profit, or loss of use. We do not recover data from devices and are not liable for data left on a device you send us, because we erase everything on arrival. Nothing in these terms limits liability that cannot be limited by law.
We may update these terms. The version in force for your transaction is the one published when you accepted your quote, or when you sold at the counter. The date at the top of this page shows when it was last changed.
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida, and both sides consent to that jurisdiction. If any part of these terms is found unenforceable, the rest continues to apply.
