The short version
- We never sell your personal data, and we don't rent or trade it.
- We never ask for your bank account number, routing number or card details.
- We erase every device we buy before it goes anywhere, and in store we do it while you watch.
- You can ask us what we hold about you and ask us to delete it.
1. What we collect
When you get a quote
The device details you enter, and nothing identifying unless you choose to continue. You can get a price without telling us who you are.
When you sell by mail
- Your name, email address and phone number.
- Your shipping address, so we can send a label and return the device if needed.
- Your payout handle — the Zelle phone number or email, the PayPal address, or the mailing address for a check. We do not collect account or card numbers.
- Device identifiers: model, IMEI or serial number, storage, and the condition you declared.
- Our inspection record, including test results and photographs of the device.
- Correspondence with us, including emails and chat messages.
When you sell in store
- Everything above that applies, plus a record of your government-issued photo ID and a signed transaction record. Florida law requires secondhand dealers to verify and record the identity of every seller and to describe each item bought.
When you use the website
- Basic technical information your browser sends: IP address, browser type, the pages you viewed and when.
- Data stored in your own browser by the quote tool, such as the devices in your cart. That stays on your device.
2. Why we collect it
- To buy your device and pay you. Contact details, address and payout handle.
- To price and inspect it honestly. Device identifiers, condition and test results, so that if we disagree on a grade we can show you what we found.
- To comply with the law. Florida's secondhand dealer rules require us to record seller identification and item details and to make those records available to law enforcement on request. We also keep what tax and accounting rules require.
- To prevent fraud and the trade in stolen goods. Serial and IMEI checks protect honest sellers.
- To answer you. Correspondence, so the next person who picks up your case has the history.
3. Who we share it with
Only where it is needed to run the transaction:
- Shipping carriers, to create a label and deliver a package.
- Payment providers such as Zelle or PayPal, which handle the transfer itself. They receive the handle you gave us, not more.
- Our service providers — email, hosting and accounting — under contracts that limit them to working for us.
- Law enforcement, where the law requires it or in response to a valid legal request.
- A buyer of the business, if Buyback Point is ever sold, under the same commitments set out here.
We do not sell personal data, and we do not share it for cross-context behavioral advertising.
4. Data on your device
Please back up and factory reset your device before you sell it, and sign out of your accounts. We do not want your data and we are not able to return it to you.
Whatever you do, we erase every device ourselves. By mail, erasure is the first step after the package is opened, before testing. In store, we do it at the counter in front of you. If a device cannot be erased because it will not boot, we physically destroy the storage instead. Business customers get a certificate of data destruction listing each serial number.
Once a device is erased, the data is gone and cannot be recovered by us or by anyone we sell it to.
5. How long we keep things
- Transaction and identification records: for the period Florida law requires secondhand dealers to retain them, and no longer than we need for tax and accounting purposes.
- Order and inspection records, including device photographs: normally three years, so we can resolve a dispute about a past sale.
- Quotes that never became orders: normally 12 months.
- Email correspondence: normally two years.
- Website logs: normally 12 months.
6. Cookies and tracking
The site uses a small number of cookies and similar browser storage. Some are necessary: they keep your quote cart and keep you signed in to an account if you have one. We also use basic analytics to count visits and see which pages people use, so we can fix the ones that don't work.
We do not run advertising trackers and we do not build advertising profiles. You can block or delete cookies in your browser settings; the quote cart and sign-in will stop working if you do.
7. Security
Data is stored on access-controlled systems, and only staff who need a record can see it. The site is served over HTTPS. Identification records from in-store purchases are kept separately with restricted access. No system is perfect, so we also limit what we collect in the first place — which is why we never take bank or card numbers.
8. Your rights
Wherever you live in the United States, you can ask us to:
- Tell you what we hold about you, and get a copy of it.
- Correct anything that is wrong.
- Delete what we hold, except records we are legally required to keep, such as secondhand dealer transaction and identification records and accounting records.
- Opt out of the sale or sharing of your personal data. There is nothing to opt out of here, because we do not sell or share it. If that ever changes, we will say so on this page first.
Florida residents have these rights under Florida's consumer data protection rules, and residents of other states have equivalent rights under their own state laws. We apply the same standard to everyone rather than sorting people by state. We will never treat you differently, or pay you less for a device, because you exercised a privacy right.
9. How to make a request
Email sell@buybackpoint.com with the subject line "Privacy request", call 305-925-0840, or come into the store. Tell us what you want and give us enough detail to find your records — usually the email address or phone number you used, or your order reference.
We will confirm your identity before acting, so that nobody else can request your data. We aim to respond within 30 days and will tell you if we need longer. There is no charge.
10. Children
We only buy from sellers aged 18 or over and the site is not aimed at children. We do not knowingly collect data from anyone under 18. If you think we have, contact us and we will delete it.
11. Changes to this policy
If we change how we handle personal data, we will update this page and change the date at the top. Material changes will be flagged on the site.
